OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100.00) OR (B) THE AMOUNTS PAID BY YOU TO ONCOLOGY DATA ADVISOR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

    10. Indemnification

You agree to defend, indemnify, and hold harmless Oncology Data Advisor and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

    12. Binding Arbitration and Class Action Waiver

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS. The arbitrator's decision is final and binding. YOU AND ONCOLOGY DATA ADVISOR EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Additional Terms

    Paid Plans, Purchases, and Refunds

    • Prices, billing periods, and included features appear at checkout and may change prospectively with notice.
    • Subscriptions renew automatically until cancelled; cancel before renewal and access continues to the end of the paid period.
    • Free trials, where offered, convert to paid unless cancelled first.
    • One-time purchases such as courses, events, or memberships grant access as described on the item's page.
    • Refunds: request a refund through our contact form within 14 days of purchase; we refund where the content, course, or event access is largely unused. Cancelling a subscription stops future renewals and access continues to the end of the paid period - we do not refund partial periods. Statutory withdrawal rights, where they apply, are unaffected.
    • Taxes are your responsibility unless stated otherwise; failed payments may result in suspension.

    APIs and Automated Access

If we grant API or programmatic access, you must use your own credentials, keep them secret, stay within published rate limits and quotas, and not resell or proxy access without written permission. We may throttle, suspend, or revoke credentials for abuse, security risk, or non-payment, and may change or deprecate endpoints with reasonable notice.

    Scraping and AI Training

Scraping or ingesting our content to train, fine-tune, or evaluate any AI, machine-learning, or large-language-model system is prohibited without our express written permission and is a material breach of these Terms.

    AI-Assisted Content

Some material is drafted with AI assistance and reviewed by a human editor before publication. AI-assisted output can still contain errors; verify anything you intend to rely on against primary sources.

    Notifications and Email

Transactional messages are part of the service. Marketing email and browser notifications are opt-in and can be withdrawn at any time using the unsubscribe link or your account settings.

    Termination and Your Data

You may close your account in settings. On termination your right to use the services stops; you may request an export of your data within 30 days, after which we delete or anonymize it under our retention schedule, except where law requires us to keep it.

    Copyright Complaints and Legal Notices

Notices of claimed infringement, subpoenas, court orders, and other formal legal notices should be submitted through our Legal Inquiries page so they are logged and routed correctly.
